COURT OF VENICE, SPECIALIZED SECTION IN THE FIELD OF ENTERPRISE

The appointed judge Dr. Martina Gasparini following the appeal for sequestration and inhibitory description, ex artt. 129, 131 and 134 c.p.i., 669 bis and ss. 670 c.p.c. proposed by TPS Srl and Daliform Group Srl ordered, towards SPIDERPLAST Srl, the injunction to produce, use and / or market and / or advertise in any form and manner, in any sales channel, including Internet, trade fairs , and in any other commercial seat, of all kinds of formwork at adjustable heights called GOLIATH or otherwise entitled in counterfeiting of the title of property indicated in the appeal;

The fine of € 500.00 was set for each violation or day of delay in the execution of the provisions;

The order was issued for the publication once, in double-normal characters, by the applicant and at the expense of the defendant, with the right of reimbursement of the invoices, in the newspaper Corriere della Sera and Gazzettino national editions;

The companies SPIDERPLAST Srl and GEOPLAST Spa were jointly and severally liable to pay the costs of the proceedings.

Une victoire au niveau international jugé par le tribunal de Venise au profit des sociétés Daliform Group et T.P.S. contre des sociétés de Padoue pour contrefaçons de brevets industriels. En plus d’avoir à défendre la propriété industrielle de ses brevets au niveau international.

Après une « bataille » qui a duré six années, la Cour de Venise – Section spécialisée dans la propriété industrielle – a condamné les sociétés GEOPLAST S.p.A. et GRANPLAST 2001 Srl, localisées à Grantorto, de payer plus de 1,5 Millions d’Euro à la société Daliform et TPS (y compris les pénalités et dépenses associées.)

Dés Mars 2011, des mesures de précaution et d’interdiction de production et de commercialisation avait été prises à l’encontre de Geoplast pour les produits « ELEVETOR » et « NAUTILUS » et plus tard, en Septembre 2013 sur le produit « Nautilus EVO ». Ces derniers étant des contrefaçons Geoplast correspondant aux systèmes originaux ATLANTIS et U-BOOT® BETON (brevets Daliform Group), qui ont fait la réputation de Daliform auprès d’Architectes mondialement connus tel que Renzo Piano, Paolo Portoghesi, Mario Botta, Zara Hadid, Libeskind, Arata Isozaki, Jean Nouvel et beaucoup d’autres encore…

Cette sentence a été publié le 29 septembre 2016 dans le « Corriere della Sera » et le 30 Septembre 2016 dans « Il Sole 24 ORE » – conformément à la décision de justice et aux dispositions de la Cour elle-même.
